Terms of Service

Last updated: October 30, 2026

1. Seller and Scope

This website is operated by SimΓ³n Valencia RodrΓguez, a sole trader trading as Softly, NIF 46094368E, at TravesΓa de Cacheiras, n.ΒΊ 87, 1B, Teo, Spain. Contact: thedreamingcase@gmail.com.

These Terms govern use of our store and purchases from it, together with our Refund & Return Policy and 30-Day Limited Warranty, Shipping Policy, and Privacy Policy. Our store uses Shopify's e-commerce platform. We currently accept delivery orders only within the delivery area stated in our Shipping Policy.

You must have legal capacity to enter the purchase contract and provide accurate contact, payment, and delivery information. Products are offered for personal household use, not for resale unless we agree otherwise.

2. Products and Descriptions

Softly Pulseβ„’ is offered for personal comfort and relaxation. The product page identifies the included functions, physical items, and any digital bonus. Do not assume an accessory, setting, certification, or clinical result is included unless it is expressly and accurately stated for the product you order.

Display settings can affect colors. Minor display-related differences are not necessarily defects, but this does not excuse a materially different product or an inaccurate description. Product fit and perceived comfort can vary between users. An accurate description and functioning product remain our responsibility under the contract and applicable law.

Changes to product listings apply to future orders; they do not silently replace the description or terms applicable when you purchased.

3. Product Use & Safety Information

Read and follow the manufacturer instructions, intended placement, charging requirements, restrictions, and warnings supplied with the exact device before use. If instructions are missing or unclear, do not guess how to use it; contact us first. Website content is not a replacement for those instructions.

Electrical stimulation and heat are not suitable for everyone. In particular, if you have a pacemaker, defibrillator, or other implanted electronic device, do not use electrical stimulation without appropriate manufacturer and medical guidance confirming suitability. If you are pregnant, have a significant medical condition, impaired skin sensation, or a recent injury or operation, obtain professional advice before considering use. This is not an exhaustive contraindication list.

Do not continue use if the device causes pain, burning, skin irritation, dizziness, or another unusual reaction. Stop using a damaged or overheating device, and contact us. Obtain medical attention where appropriate.

Our product descriptions and complimentary e-book provide general information, not an individualized diagnosis or treatment plan. We do not promise that the product will treat fibromyalgia, vertigo, a structural neck deformity, or another medical condition, or provide a particular result within a particular period. Do not delay medical care because of store content.

These statements do not establish a regulatory classification or claim FDA approval or clearance. They do not exclude liability for unsafe products, misleading descriptions, or obligations imposed by law.

4. Pricing, Payment, and Orders

Prices and charges are displayed in U.S. dollars unless checkout expressly identifies another currency. Applicable sales taxes are shown before you pay. Standard shipping is free as described in our Shipping Policy. We do not add undisclosed handling charges after checkout.

An automated acknowledgment confirms receipt of an order. Acceptance occurs when we confirm dispatch, unless applicable law establishes an earlier contract. Taking payment does not permit us to retain it for an order we cannot fulfill.

We may refuse or cancel an order for a genuine stock shortage, a material pricing error, failed payment verification, a reasonable fraud concern, an unserviceable address, or a suspected unauthorized resale order. We will notify you and refund any amount paid for an order we cancel. We will not substitute a more expensive product or charge a corrected price without your agreement.

If a mistake affects an order already placed, we will explain the available options subject to applicable law. We do not reserve a general right to change the price of a completed purchase retrospectively.

5. Shipping and Cancellation

Processing, delivery estimates, tracking, and delivery issues are addressed in our Shipping Policy. Request cancellations or changes immediately. The 12-hour administrative request window described in the Refund & Return Policy is not an exclusion of statutory cancellation or shipment-delay rights.

We remain responsible for obligations imposed on the seller; referring to a carrier or fulfillment partner does not automatically transfer those obligations to you.

6. Returns and the Limited Warranty

There is no voluntary change-of-mind return or satisfaction trial, including for unopened items. The 30-Day Limited Warranty covers specified defects, not dissatisfaction with an otherwise correctly described, functioning product. Read the full Refund & Return Policy and 30-Day Limited Warranty before ordering.

Defective, transit-damaged, incorrect, materially misdescribed, or undelivered orders are handled under the applicable policies and mandatory law. Nothing in these Terms removes an express promise made with your order or a remedy the law requires.

7. Promotions and Digital Bonuses

The conditions of an offer apply as disclosed before purchase. Discounts cannot be combined unless the offer expressly permits it. Subsequent price changes do not alter amounts already paid.

Refund calculations for multi-unit offers are set out in the Refund & Return Policy. A complimentary e-book has no separately refundable cash value and is not assigned an artificial value to reduce a valid physical-product refund.

You receive a personal, noncommercial license to use a supplied digital guide. You may not resell or publicly redistribute it without permission, except as permitted by law. The guide is educational and is not a substitute for professional advice or product instructions. If digital access is missing or the file is unusable, contact us for assistance.

8. Website Use, Content, and Links

You may not use the site for unlawful activity, payment fraud, harassment, unauthorized access, malware, or infringement of another person's rights. We may restrict access for a legitimate reason, without extinguishing obligations relating to existing orders.

Site materials belong to us or the relevant rights holders and are used with permission where required. Access does not grant commercial reuse rights. Statutory exceptions remain available.

Third-party sites and optional services have their own terms. Their inclusion is not necessarily an endorsement. We are not responsible for matters outside our control, but do not exclude responsibilities that legally remain ours.

9. Customer Reviews and Communications

You retain ownership of your reviews. By submitting a review for publication on our store, you grant a nonexclusive, royalty-free permission to display it there and format it for readability without changing its meaning. We do not acquire ownership of your review or require a positive opinion.

We may remove unlawful material, private information, spam, or content unrelated to the product or experience. We do not prohibit honest negative reviews or condition a valid warranty remedy on changing or removing a review. Private support emails and claim photographs are not permission to use them in advertising; we will seek appropriate separate permission.

Personal information is handled as described in our Privacy Policy. Do not send full payment-card information or unnecessary medical records by email.

10. Warranties and Liability

The express warranty is stated in the Refund & Return Policy and 30-Day Limited Warranty. These Terms do not disclaim implied product warranties or shorten mandatory warranty periods. We do not guarantee uninterrupted website availability, but will take reasonable steps to address problems within our control.

To the extent permitted by applicable law, we exclude liability for indirect or consequential business losses arising from use of the website. This exclusion does not apply where prohibited, does not reduce remedies under the product warranty, and does not exclude responsibility for fraud, willful misconduct, gross negligence, personal injury, death, defective-product liability, or any liability that cannot lawfully be excluded.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so any such exclusion or limitation may not apply to you. Nothing requires you to indemnify us for our own wrongdoing or waive a mandatory consumer remedy.

11. Complaints, Governing Law, and Changes

For complaints, contact thedreamingcase@gmail.com. Contacting us does not require you to waive a card dispute, complaint to an authority, or access to a court, and does not suspend legal deadlines. We do not impose mandatory arbitration or a fixed waiting period before you may exercise those rights.

These Terms are governed by Spanish law, subject to all mandatory consumer protections applicable to your purchase, including applicable U.S. federal and state law. This clause does not require you to use a foreign court where applicable law gives you another competent forum.

We may update these Terms for future transactions. An update does not retroactively reduce rights attached to an existing order. If a provision is unenforceable, the remaining provisions apply to the extent lawful. No entire-agreement wording excludes binding pre-contract statements or rights that cannot be waived.
